Requirements to Study in the US After Obtaining an I-130 Visa

I recently got my I-130 visa. Can I study in the US with it, or do I need a different visa? What are my options?

It's excellent that you're considering furthering your education in the United States. The I-130 form is an immigrant petition that's typically filed by a U.S. citizen or permanent resident to establish a family-based relationship to help their relative immigrate to the U.S.

The fact that you have an approved I-130 indicates that you're likely eligible to apply to become a legal permanent resident, also known as a 'green card' holder. As a green card holder, you would indeed be eligible to study in the United States without needing a separate student F-1 visa.

However, actually obtaining a green card is a separate process, with some additional steps beyond just the I-130 petition. You'll also need to file an I-485 application to adjust your status to a permanent resident. Until you achieve that status, you should not assume that you can study in the U.S. without a separate student visa.

If you want to study in the U.S. before getting a green card, you might need to obtain an F-1 student visa. This requires that you first get accepted into a school that is certified by the Student and Exchange Visitor Program (SEVP). Once you're admitted, you will receive a Form I-20 from the school, indicating that you have been admitted to a full-time study program. You can then use the I-20 to apply for an F-1 visa.

Finally, I strongly advise that you research thoroughly and consult with an immigration attorney or specialist to understand the best options for your situation and to ensure you follow the proper legal procedures. Because every individual's situation is unique, and immigration rules can be complex, personalized advice is crucial.
